Terms and Conditions of Use.

Introduction

These terms apply to your use of andrewheeleyphoto.com, including its sub-domains unless they have their own terms (the "Website"). The Website is owned and run by Andrew Heeley, trading as Andrew Heeley Photo ("I", "me", "my"). By using the Website, you agree to these terms. If you don't agree, please stop using the Website.

These terms cover use of the Website only. If you book my photography services, your booking is governed by the Photography Agreement you sign. Where the two differ, the Photography Agreement takes priority.

"You" means anyone who uses the Website, except people working with me who are using it as part of that work.

Intellectual property and acceptable use

1- All content on the Website belongs to me or is used with its owner's permission. This includes photographs, text, graphics, video, page layout and code (the "Content"). The Content is protected by copyright and other intellectual property rights. Nothing on the Website gives you permission to use any trademark or logo shown on it without the owner's written permission.

2- You may view the Content, and share links to pages of the Website, for your own personal, non-commercial use.

3- You must not otherwise copy, reproduce, modify, distribute or commercially use any Content without my written permission. If you're a couple I've photographed, your use of your own photographs is covered by your Photography Agreement.

Prohibited use

4- You must not use the Website: a. in any way that damages it or interferes with anyone else's use of it; b. in any way that is unlawful, harmful, abusive, harassing or threatening; c. to copy or store copyright Content without the owner's permission; d. to scrape, download or collect Content (including photographs) by automated means, or to use any Content to train, test or develop artificial intelligence or machine learning systems.

Links to other websites

5- The Website may link to other websites. Unless I say otherwise, I don't control those websites.

6- I'm not responsible for the content of other websites and accept no liability for any loss or damage arising from your use of them.

7- A link to another website doesn't mean I endorse it or the people who run it.

Privacy Policy

8- Your use of the Website is also governed by my Privacy Policy, which forms part of these terms: andrewheeleyphoto.com/privacy-policy.

Availability of the Website and disclaimers

9- The Website and the information on it are provided free of charge, "as is" and "as available". I try to keep the information accurate and up to date, but I can't guarantee it's free of errors or always current, and I don't have to update it. Prices and package details are confirmed in your booking proposal.

10- I take reasonable steps to keep the Website secure and free of viruses and other malware, but I can't guarantee this. Please take sensible steps to protect your own devices and personal details.

11- I accept no liability if the Website is disrupted or unavailable.

12- I may change, suspend or remove any part of the Website, or all of it, at any time. These terms continue to apply to any changed version of the Website unless I say otherwise.

Limitation of liability

13- Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited or excluded.

14- I'm not liable for losses caused by events beyond my reasonable control.

15- As far as the law allows, I accept no liability for:

a. business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or opportunities;

b. loss or corruption of any data, database or software;

c. any special, indirect or consequential loss or damage.

Nothing in these terms affects your legal rights as a consumer.

General

16- You may not transfer your rights under these terms to anyone else. I may transfer my rights where I reasonably believe your rights won't be affected.

17- I may update these terms from time to time. Updated terms apply from the date they're published on the Website, so please check them regularly.

18- These terms, together with the Privacy Policy, form the whole agreement between us about your use of the Website. They replace any earlier discussions or arrangements about it. They don't replace or change any Photography Agreement between us.

19- The Contracts (Rights of Third Parties) Act 1999 does not apply to these terms, and no one else has the right to enforce them.

20- If a court or other authority finds any part of these terms invalid or unenforceable, that part will be treated as deleted and the rest will continue to apply.

21- If either of us delays or doesn't exercise a right under these terms, that doesn't mean we've given up that right.

22- These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
